We collaborate with leading electric vehicle brands across India to provide a seamless experience for individuals and businesses.

2. Definitions

• "Platform" refers to BharatEV, the website, and associated services.
• "User", "you", or "your" refers to any individual or entity accessing the Platform.
• "Seller" refers to users who list their electric vehicles or related products for sale.
• "Buyer" refers to users who browse or purchase electric vehicles or related products.
• "Content" includes text, images, videos, listings, and all forms of information uploaded to the Platform.
• "We", "our", or "us" refers to BharatEV.

3. Account Registration

To use certain features of the Platform, you must create an account. You agree to:

• Provide accurate, complete, and current information during registration.
• Maintain the confidentiality of your account credentials.
• Notify us immediately of any unauthorized use of your account.
• You are solely responsible for activities that occur under your account. BharatEV is not liable for any loss or damage arising from unauthorized access to your account.
• Users must be at least 18 years of age to create an account and use the Platform.

4. User Obligations

By using the Platform, you agree:

• Not to post or upload false, misleading, or fraudulent listings.
• To ensure all information about the products you list is accurate and complies with Indian laws.
• Not to engage in activities that:
  • Violate local, state, or national regulations.
  • Involve spamming, hacking, or unauthorized access to the Platform.
  • Infringe on intellectual property rights of others.
• To complete all transactions in good faith.

BharatEV reserves the right to suspend or terminate any account found to be in violation of these Terms.

5. Listing and Selling Vehicles

Sellers must provide complete and clear information regarding the electric vehicles, including:

• Vehicle make, model, specifications, and condition.
• Price, availability, and warranty details.
• Accurate images and descriptions.

Sellers warrant that:

• They have the legal right to sell the listed vehicle.
• The vehicle is free from encumbrances and legal disputes.
• All claims made in the listing are truthful.

BharatEV reserves the right to review, approve, or remove any listing that violates these Terms or is deemed inappropriate.

6. Buying Vehicles

Buyers are responsible for:

• Verifying the authenticity of the listings.
• Conducting their due diligence before making a purchase.

Any transaction between the Seller and Buyer is a contractual agreement between the two parties. BharatEV acts as a facilitator and does not guarantee the condition, performance, or quality of listed vehicles.

BharatEV is not liable for disputes, refunds, or grievances related to transactions. However, we encourage users to report any suspicious or fraudulent activity for review.

7. Collaboration with Brands

BharatEV partners with leading electric vehicle brands in India to provide authentic and high-quality products. However, we are not the manufacturers of these vehicles. All claims regarding product quality, performance, and warranties rest solely with the respective brands and sellers.

8. Payment Terms

BharatEV may provide payment solutions to facilitate transactions. Payment terms include:

• Secure and encrypted payment gateways.
• Full or partial payment options, as defined in the listing.

Buyers and Sellers agree that BharatEV is not responsible for:

• Payment disputes between parties.
• Refunds, unless explicitly agreed upon.

All applicable taxes (e.g., GST) must be included in the listing price and paid in compliance with Indian tax regulations.

9. Intellectual Property Rights

BharatEV owns all intellectual property rights related to the Platform, including:

• Website design, logo, trademarks, and content.

Users retain ownership of their listings and content but grant BharatEV a non-exclusive, royalty-free, worldwide license to use, display, and promote such content on the Platform.

You may not reproduce, modify, or use any Platform content without prior written permission.

10. Prohibited Activities

While using the Platform, you agree not to:

• Post inappropriate, misleading, or harmful content.
• Use the Platform for unauthorized commercial activities.
• Attempt to interfere with Platform security.
• Sell counterfeit or stolen electric vehicles or accessories.
• Discriminate or harass other users.

Violations may lead to permanent account suspension and legal action.

11. Third-Party Links and Services

The Platform may contain links to third-party websites, brands, or services. BharatEV does not endorse, control, or assume responsibility for any third-party content, products, or services.

Users access such links at their own risk.

12. Limitation of Liability

To the maximum extent permitted by law:

BharatEV shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform. BharatEV does not guarantee the accuracy, completeness, or reliability of listings or content provided by users. Our liability in any case shall not exceed the total fees paid to us (if any) within the past 3 months.

13. Indemnification

You agree to indemnify and hold BharatEV, its affiliates, employees, and partners harmless from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

• Your breach of these Terms.
• Your use of the Platform.
• Any disputes or transactions with other users.

14. Termination

BharatEV reserves the right to:

• Suspend or terminate your account without notice if you violate these Terms.
• Remove or modify content that breaches our policies.
• Discontinue the Platform or any part of it at our discretion.

Upon termination, all rights granted to you under these Terms shall cease immediately.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of courts located in Gurugram, Haryana only. Users are encouraged to resolve disputes amicably before seeking legal remedies.
